An empty leg is a positioning flight — a seaplane returning empty (or repositioning) that a Part 135 operator would otherwise fly without paying passengers. In Indonesia it can only be offered as the whole aircraft, on a route and time the operator already has fixed, under the same safety, crew and airworthiness rules as any paid charter. Selling individual seats on an empty leg is not permitted.

How do empty legs arise?

Empty legs are a by-product of how charter aircraft actually move, not a discount product an operator builds in advance.

  • Repositioning after a drop-off. A seaplane that flew a group out to Bawah Island or a resort transfer often has to fly back to base, or forward to its next job, with no one on board.
  • Base returns at the end of the day. Aircraft based at a mainland water aerodrome return there overnight; a late-afternoon return leg can occasionally be released.
  • Multi-day programmes. A corporate or resort charter booked across several days can leave a gap leg between segments — the aircraft has to be somewhere for day two regardless of whether anyone is flying that particular hop.

None of this is scheduled. An operator only knows it has a positioning flight once the paid leg is confirmed, which is usually a matter of days, sometimes hours, before departure.

What is the realistic saving?

An empty leg typically prices below the full charter rate, because the operator is recovering a flight it would otherwise fly at a loss — but the size of that discount is the operator’s own commercial decision, set leg by leg. There is no published national empty-leg discount rate for Indonesian seaplane charter, and the desk does not quote a percentage it cannot verify against an actual operator offer. Treat any figure you see elsewhere for “average empty-leg savings” as unverified until an operator confirms a specific quote for a specific leg.

What are the rules?

Commercial seaplane charter in Indonesia, empty legs included, sits inside the same regulatory frame as any other charter flight:

  • Part 135 Air Operator Certificate required. Only an operator holding a valid CASR Part 135 AOC may conduct a commercial charter flight, and empty legs are marketed under that same certificate — same safety, crew and airworthiness standards as a paid charter, not a relaxed version of them.
  • Whole aircraft only. An empty leg is sold as the entire aircraft on the operator’s predetermined route and time. Selling individual tickets on it is prohibited.
  • Documentation and transparency. Operators are expected to document empty-leg offers and keep them transparent to the Directorate General of Civil Aviation (DGCA, part of the Ministry of Transportation), which retains oversight of the practice.
  • Domestic cabotage rule. Aviation Law No. 1 of 2009 bars foreign carriers from carrying passengers between two points inside Indonesia. The Transportation Ministry has separately reiterated that routing around this through online travel agents still violates the law — so a domestic seaplane leg, empty or paid, has to be flown by an Indonesian AOC holder.
  • Water aerodrome coordination. Since a ministerial regulation enacted 22 August 2025 (State Gazette 2025 No. 620), water aerodrome organisers must coordinate movements with coastal radio stations and Vessel Traffic Service (VTS) units, and operations on the water follow shipping-sector rules in addition to aviation ones.
